% 08.08.2016 C.M. Appl. No. 28562/2016 (under Section 151 CPC seeking directions to prepare decree, moved on behalf of the appellant) 1.

The Registry is notified that all Regular First Appeals, including the Land Acquisition Appeals, when they are disposed of on merits, a decree necessarily has to be drawn up because the judgment of the trial court merges into the judgment and decree which is passed by this Court.

I am finding that in many cases decrees are not being prepared by the Registry of this court. I fail to understand that on what ground LA.APP. 99/2013

decrees are not being prepared and litigants are harassed for filing applications to direct the Registry to prepare a decree. Therefore, besides directing preparation of the decree in the present Land Acquisition Appeal, a copy of this order be placed before Hon'ble the Chief Justice so that necessary directions be issued to the Registry that in all Regular First Appeals, which are filed with respect to Civil Suits or Land Acquisition Appeals or in any other Regular First Appeals where a decree is required to be drawn, Registry must prepare decrees suo moto without litigants having to approach this Court for directions for preparation of the decrees. 3.

C.M. stands disposed of.
