Petitioner is defending a recovery suit filed under Order XXXVII CPC and the grievance is with respect to grant of conditional leave to defend. 2.

However, Mr. Raj Kumar, learned counsel for petitioner, submits that the matter has been amicably settled between the parties and in terms of settlement, the plaintiff i.e. Ms. Shoby Khan has already withdrawn the abovesaid suit on 04.03.2025.

He, therefore, submits that he does not press the petition as it has become infructuous.

In view of the above, the present petition, along with pending application, is disposed of as having become infructuous.
