O R D E R

The present petition has been filed on behalf of the petitioner seeking quashing of FIR No. 159/2017 registered under Sections 498-A/406/34 IPC at P.S. CWC, Nanakpura, New Delhi on the ground that the parties have amicably settled their disputes.

The present FIR is an outcome of a matrimonial dispute between the complainant/respondent No. 2 (wife) and husband of respondent no.2 (who has since expired). The petitioner is the mother-in-law of the complainant/respondent no.2.

husband of the respondent no.2 namely Gaurav Chib has since expired and father-in-law of respondent no.2 namely Shri Swaran Chib has been discharged. He further states that the present petitioner is the mother-in-law of respondent No.2.

Learned counsel for the petitioner submits that the parties have settled their disputes vide MoU dated 09.09.2024. In terms of the settlement, the parties have settled their disputes. He further states that there is a girl child born out of the wedlock who is in the custody of respondent no.2. 5.

Petitioner, who is present in Court, has been identified by her counsel as well as by I.O./ SI Vijay Pal Singh PS CWC Nanak Pura, New Delhi. 6.

Respondent No. 2 who has joined the proceedings through VC and has been identified by the I.O., states that she has settled her disputes with the petitioner of her own free will, volition and without any coercion. She submits that she has no objection in case the FIR is quashed against the petitioner.

Learned counsel for the petitioner, on instructions states that rights of the minor child, who is in the custody of respondent No.2, as available under the law shall remain unaffected by the terms of the settlement. In acknowledgement of the said statement, petitioner and her counsel have signed the order sheet.

Learned counsel for the petitioner submits that no other proceedings are pending between the parties.

The parties shall remain bound by the statements and undertaking made in Court today.

In view of the above facts and since no useful purpose will be served in continuance of the present criminal proceedings, it is directed that the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed.

With the above directions, the petition is disposed of alongwith miscellaneous application.
