This is a petition filed under section 14(1)(b) read with section 15(2) of the Arbitration and Conciliation Act, 1996 seeking substitution of the arbitrator.

The appointed arbitrator i.e. Hon'ble Mr. Justice V.K. Shukla (Retd.), Allahabad High Court has passed away.

Learned counsel for the petitioner suggests the name of Hon'ble Mr. Justice Harsh Kumar (Retd.), Allahabad High Court as the Sole Arbitrator. 4.

Learned counsel for the respondent has no objection to the same. 5.

In this view of the matter, with consent of parties, Hon'ble Mr. Justice Harsh Kumar (Retd.), Allahabad High Court is appointed as the Sole Arbitrator to adjudicate the dispute between the parties, who will commence the proceedings from the stage of final arguments. With consent of parties, it is directed that the Sole Arbitrator is entitled to fix his own fee but it shall not exceed a maximum of Rs. 10 lakhs in total (to be shared equally).

Since the earlier Sole Arbitrator has unfortunately passed away, the mandate of the Arbitral Tribunal is also extended for a period of 6 months from today.
