CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 17.07.2018 By this petition under section 439(2) of Code of Criminal Procedure, 1973 (Cr.P.C.), petitioners have prayed as under:

"It is, therefore, prayed that the notice be issued to the respondents nos.2 to 7 so as to show cause why their bail be not cancelled as ordered by this Court vide order dated 30.08.2016." The order dated 30.08.2016 was passed in the bail application filed by one Shri Ajay Kapoor.

Initially, vide order dated 19.01.2016 interim

protection from arrest was passed in favour of said Shri Ajay Kapoor. Finally, the said application was disposed of as withdrawn on 13.04.2017. Investigations in the FIR involved in the said bail application are complete inasmuch chargesheet is stated to have been filed. Learned counsels for the respondents submit that respondents including respondent no.7 (Ajay Kapoor) have been granted regular bail by the Trial Court after the filing of the chargesheet.

The bail application filed by Shri Ajay Kapoor wherein interim order dated 30.08.2016 was passed has already been disposed of as withdrawn. It is not the case that respondents are enjoying the benefit of interim protection granted in the anticipatory bail application filed by Shri Ajay Kapoor. For the foregoing reasons, present petition is dismissed. A.K. PATHAK, J JULY 17, 2018 'Sn'
