The petitioner retired as a Teacher from respondent No. 1 - Guru Harkishan Public School ["the School"] on 28.02.2025. 3.
Mr. Abinash Kumar Mishra, learned counsel, has entered appearance on behalf of the School pursuant to notice issued on 09.09.2025.
4.
My attention has been drawn to a communication dated 10.04.2025, by which the School forwarded to the petitioner a calculation sheet reflecting the pending dues until the date of her superannuation. The amount due, as computed by the School, is to the tune of Rs. 29,04,520/-. The petitioner disputes this computation and seeks disclosure of the basis on which the School has arrived at these figures. 5.
Having regard to the fact that there is no dispute on the question of liability, what is required now is only reconciliation of accounts and fixation of the modalities of payment. I am of the view that this task may first be undertaken by the Directorate of Education ["DoE"]. 6.
The writ petition, alongwith the pending application, is therefore, disposed of, with the following directions:- a. The School is directed to furnish its computation, alongwith the basis thereof, to the petitioner within two weeks, and also to submit a copy to the concerned Deputy Director of Education ["DDE"]. b. If the computation is disputed, the petitioner may furnish her computation, alongwith the basis thereof, to the School and the DDE within two weeks thereafter.
c. The DDE is directed to hold a meeting with the representatives of both parties and give necessary directions regarding the quantum payable and the schedule of payment, within four weeks thereafter. The rights and contentions of the parties remain reserved in the event of any remaining grievance.
8.
Mr. Kumar submits that some amount may be released to the petitioner in the interim. Following the order of this Court inter alia in Shikha Sharma v. Guru Harkrishan Public School & Ors. [W.P.(C) 3746/2020 and connected matters, decided on 16.11.2021], and keeping in mind that the dues to the tune of Rs. 29,04,520/- are admitted by the School, the School is directed to release an amount of Rs. 5 lakhs to the petitioner within four weeks from today, and a further sum of Rs.2.5 lakhs within four weeks thereafter. The remaining amount will be paid in accordance with the directions of DoE.
