In paragraph no. 7 of the counter-affidavit, the respondent-Union of India, has taken the following position.

"7. That the contents of Para 10 are only admitted to the extent that the Petitioner preferred an appeal dated 18.07.2024 against the speaking order dated 05.07.2024 of the Respondent. It is pertinent to mention here that the Head of the Department, Chief Engineer duly considered the said representation and vide its communication dated 14.10.2024, inquired from the Petitioner for any specific discrepancy and/or oversight by the Respondent while issuing impugned the Speaking Order dated 05.07.2024. In fact, the Petitioner has not yet replied to the said communication of the Head of Department, Chief Engineer, Delhi Zone." 2.

It is, thus, seen that an appeal has been preferred by the petitioner against order dated 05.07.2024 which is pending for consideration. 3.

Let the petitioner to pursue the said remedy and to cooperate with the concerned authority in expeditious disposal of the appeal.
