Writ Petition under Articles 226/227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been filed on behalf of the Petitioner challenging Look Out Circular (LOC) dated 03.01.2024 in connection with FIR No.0174/2022 dated 28.02.2022, under Sections 498A/406/34 IPC, registered at PS: Vivek Vihar, Delhi.

Learned counsel for Respondents submit that Chargesheet has been filed against other co-accused, though not against the Petitioner Taresh Singh Chauhan, as he had failed to join the investigation. Reliance is placed on the case of Sumer Singh Salkan & Ors. vs. Asstt. Director & Ors., MANU/DE/1937/2010, wherein Co-ordinate Bench of this Court had observed that LOC is coercive measure to make a person surrender to the investigating agency or Court of law. The Courts' jurisdiction in affirming or cancelling LOC is commensurate with the jurisdiction of cancellation or affirming NBWs.

In view of aforesaid, learned counsel for the Petitioner seeks permission to withdraw present Writ Petition with liberty to move appropriate Application before the learned Trial Court to challenge / recall LOC dated 03.01.2024.

Accordingly, Writ Petition along with pending Applications is dismissed as withdrawn with liberty, as prayed for. NEENA BANSAL KRISHNA, J.
