O R D E R

% 27.02.2018 Vide the present petition, the petitioner/Institute has prayed for issuance of a direction to respondent no.3 to grant approval to the faculty list prepared by the petitioner under Clause 7 (13) of NCTE Regulations, 2014 expeditiously within a period of seven days to enable respondent no.2 to examine the same and grant formal recognition to the petitioner/Institute for the academic session 201819 before the prescribed cut off date i.e. 3rd March, 2018. Notice in this petition had been issued vide order dated 26th February, 2018. Mr. Deepak Thukral, learned counsel for the respondent no.3, submits that the said respondent has received an application submitted on behalf of the petitioner seeking approval of the faculty list, only on 23rd February, 2018 and, therefore, a decision on the same could not be taken due to paucity of time. He, however,

submits that keeping in view the urgency of the matter and the earlier decision passed by this Court, he has instructions to state that respondent no.3 would do the needful after examining the faculty list by 28th February, 2018. He, however, submits that to assist the respondent no.3 to take expeditious decision, the authorised representative of the petitioner may be directed to appear in the office of respondent no.3 on 28th February, 2018 at 11.30 a.m. along with all supporting documents. Ordered accordingly. Learned counsel for the respondent no.3 further submits that in case the faculty list is found to be in order, the respondent no.3 will ensure that an appropriate order is passed on 28th February, 2018 itself approving the faculty list. In the event, respondent no.

3 approves the faculty list submitted by the petitioner, respondent no.3 would communicate its decision to the petitioner on 28th February, 2018 itself so as to enable the petitioner to submit the same to respondent nos.1 & 2 for processing its application for grant of recognition before the cut-off date i.e. 3rd March, 2018. The petition and application are disposed of in the aforesaid terms.
