Learned counsel for the petitioner seeks leave to withdraw the present petition while reserving the right of the petitioner to file a substantive representation with the respondent No.2/ITBP for the relief prayed in the present petition by citing a recent decision of the Supreme Court, which is stated to be in favour of the petitioner.

If the petitioner submits such a representation within four weeks from today, the respondents shall examine the same and pass a speaking order under written intimation to him within eight weeks thereafter. 3.
In case, the grievance of the petitioner still survives he shall be entitled to seek legal recourse.
