O R D E R
% 10.03.2016 The present bail application has been filed by the applicant aggrieved by the order of the rejection of bail by the Court of Session vide its order dated 19th February, 2016.
During the course of argument, the admitted fact is that the main accused in the present case is Mr.Vipin Kohli who is presently on the interim bail by virtue of the order of learned Additional Sessions Judge.
Learned APP for the State has submitted that the petitioner is avoiding to join investigation with the investigating officer and he may be directed to join the investigation.
In the facts and circumstances, the bail application of the petitioner is partially allowed to the extent that the petitioner shall have the concession of the anticipatory bail on the same parameters
and for the same period on which Mr.Vipin Kohli is enjoying concession of bail, on the ground of parity.
Consequently, this Court is of the considered opinion that keeping in view the facts and circumstances, the petitioner/accused, shall be released on bail on his furnishing personal bond for a sum of Rs.25,000/- as well as two sureties of the like amount to the satisfaction of the Court below subject to the condition that the petitioner shall join the investigation as and when required; shall not influence the prosecution witnesses or tamper with the evidence and shall not leave the country without prior permission of the Court concerned With the above observation, the present bail application is allowed.
