O R D E R

% 09.09.2025 1.

The present bail application is filed by the applicant seeking regular bail in FIR No. 549/2017 dated 13.07.2017, registered at police station New Usmanpur for the offences under Sections 302/34 of the Indian Penal Code, 1860 ('IPC'). 2.

The learned counsel for the applicant submits that the applicant is in custody since 20.07.2017 and the trial has still not concluded.

The bail application filed by the applicant on earlier occasion was dismissed by this Court by order dated 03.07.2024, specifically noting that long incarceration of accused behind bars cannot be perse the only ground for release the applicant on bail, in view of seriousness of the allegations. The Court also noted that there is ample prima facie material available against the applicant. Undisputedly, considerable period of time has been spent by the applicant in custody and the trial has still not been concluded. On being asked, it is informed that 28 out of 40 witnesses have been examined.

However, the same itself cannot be a ground for release of accused on bail when there is prima facie ample evidence against the accused and on conviction the minimum sentence is imprisonment for remainder of life.

Considering the above, the present bail application stands disposed of with a direction to the learned Trial Court to make endeavour for conclusion of trial within a period of 6-8 months. 7.

Pending application also stands disposed of.
