The present petition is filed seeking quashing of FIR No. 481/2024 dated 28.12.2024, registered at Police Station Kirti Nagar, for the offences under Sections 115(2)/127(2) of the Bharatiya Nyaya Sanhita, 2023 ('BNS'), including all consequential proceedings arising therefrom. The chargesheet has been filed in the present case for the offences under Sections 117(2)/125(2)/3(5) of the BNS.

The brief facts are that Respondent No. 2 is a shopkeeper in the locality of Ramesh Nagar, Delhi. It is alleged that Petitioner No.1 called Respondent No.2 to place an order from his shop but when Respondent No.2 asked him to pay via Paytm he started abusing him. Subsequently, Petitioner No.1 came to the shop of Respondent No.2 and allegedly started abusing him, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
consequently, Respondent No.2 called Petitioner No.1's home landline and asked his family to take him away. It is alleged that Petitioner No.1 entered the shop, twisted Respondent No.2's arm and was thrown out of the shop. Subsequently, Petitioner No.1 allegedly entered the shop of Respondent No.2 along with Petitioner Nos. 2-4 and gave beatings to Respondent No.2 due to which he allegedly received severe injuries.

The learned counsel for the petitioners submits that the parties are neighbours and an altercation arose between the parties due to petty disputes. He submits that the parties have since resolved their disputes and decided to live peacefully in the future.

The present petition is filed on the ground that the matter has been amicably settled between the parties by way Settlement Agreement dated 23.04.2025, with the intervention of neighbours, well-wishers and respectable members of the society, out of their own free will, without any coercion, pressure or undue influence.

The parties are present in the Court and have been duly identified by the Investigating Officer.

On being asked, Respondent No.2 states that he has no remaining grievance against the petitioners. He states that he does not wish to pursue the proceedings arising out of the present FIR and has no objection if the same is quashed. 7.
Offences under Sections 115(2)/127(2) of the BNS are compoundable.

This Court is of the opinion that no useful purpose would be served by relegating the parties to the learned Trial Court for filing an application to compound the offences. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Keeping in view the nature of the dispute and that the parties have amicably resolved their disputes, this Court feels that no useful purpose would be served by keeping the dispute alive and continuance of the proceedings would amount to abuse of the process of Court. I am of the opinion that this is a fit case to exercise the discretionary jurisdiction under Section 528 of the BNSS.

However, keeping in mind the fact that the State machinery has been put to motion, ends of justice would be served if the petitioners are put to cost.

In view of the above, FIR No. 481/2024 and all consequential proceedings arising therefrom are quashed, subject to payment of cost of ₹25,000/- by petitioner to be deposited with the Delhi Police Martyrs' Fund, within a period of six weeks from date.

Let the proof of deposit of cost be submitted to the concerned SHO.

The present petition is allowed in the aforesaid terms. Pending application also stands disposed of.
