The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (erstwhile Section 482 of the Code of Criminal Procedure, 19731) assails the impugned order dated 21st April, 2025 passed ASJ (SFTC), Dwarka Courts, New Delhi. By the impugned order, the Sessions Court upheld the order dated 21st September, 2023 passed the Metropolitan Magistrate, South-West, Dwarka Court, New Delhi in Ct. Case 331/2023 thereby dismissing the application of the Petitioners under Section 156 of Cr.P.C.

Counsel for the Petitioner states that the observations made by the Sessions Court in the impugned order, particularly in para no. 7 and 13, concerning the disclosure of offences of forgery and cheating, may prejudice 1 "Cr.P.C."

the adjudication of the Petitioner's private complaint arising from the same facts, which is presently pending.

In light of the above, it is clarified that the observations made in para no. 7 and 13 of the impugned order, shall only be considered as a prima facie view of the case and shall not affect the adjudication of the Petitioner's private complaint, which shall be decided on its own merits based on the evidence advanced by the parties.

With the above directions, the present petition is disposed of along with pending applications.
