By way of the present petition, the petitioner is seeking quashing of the FIR bearing no. 358/2021, registered at Police Station Daryaganj, Delhi for the commission of offences punishable under Sections 135/150 of the Indian Electricity Act, 2013.

present before this Court and have been identified by Investigating Officer (IO) concerned, Police Station Daryaganj, Delhi. 6.

Brief facts of the present case are that inspection was carried out on 01.09.2021 at 02:00 P.M., by the joint team of BSES YPL at the above said premises, during the course of inspection one meter no. 70247763 reading 11311 kwh was found installed at, BSES allotted consumer single phase meter but the accused one phase meter and other 2 phase illegal used in 3 phase supply use by the accused, the two phase supply illegally connected with the copper w1res through BSES common bus bar through FP RCCB 63 amp MCB for direct theft of supply and the total connected load was found 35.358 KW/NX/DT (Non Domestic) as alleged. Thereafter, the present FIR was registered against the petitioner herein under the relevant sections. 7.

On a query made by this Court, authorised representative appearing on behalf of the respondent no. 2/BSES, has categorically stated that he has no objection if the FIR is quashed.

In view of the above, that the parties have amicably resolved their differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9.

Accordingly, FIR bearing no. 358/2021, registered at Police Station Daryaganj, Delhi for the commission of offences punishable under Sections 135/150 of the Indian Electricity Act, 2013 and all consequential proceedings emanating therefrom are quashed.
