The present petition has been filed by the petitioner seeking quashing of speaking order dated 21.08.2025 as well as praying for a direction to respondent/DDA to pass a fresh speaking order after taking into consideration detailed representation filed by petitioner. 2.

Mr. Anurag Ahluwalia, learned Sr. Counsel appearing on behalf of petitioner submits that earlier, the petitioner had filed a petition being W.P.(C) 10683/2018 titled as M/s. Gautam Properties (Delhi) Pvt. Ltd. and Anr. v. Delhi Development Authority and Anr., which was disposed of vide order dated 06.05.2025 with a direction that DDA will consider the representation of petitioner and decide the same within a period of eight weeks from the date of order.

He submits that after the said order was passed, petitioner became ill and for the said reason, representation could not be made by him.

To buttress his contention, he has invited attention of the Court to the medical records of petitioner. He submits that the impugned speaking order has been passed by respondent/DDA on 21.08.2025 in the absence of representation of the petitioner. He contends that in view of the peculiar facts, speaking order passed by respondent/DDA may be set aside and another opportunity to make fresh representation may be afforded to petitioner.

In view of above, issue notice.

Ms. Sanjay Katyal, learned standing counsel appearing on behalf of respondent/DDA accepts notice.

This Court finds substance in the submission of Mr. Ahluwalia that petitioner could not make his representation because of his medical condition.

Accordingly, impugned speaking order dated 21.08.2025 is set aside and petitioner is granted opportunity to make fresh representation to respondent/DDA within a period of two weeks from today.

Respondent/DDA shall decide fresh representation so made by petitioner within a period of eight weeks thereafter.

The speaking order passed by respondent/DDA may be communicated to petitioner as well as to petitioner's counsel within two weeks thereafter.

Petition and pending applications stand disposed of in the above terms.
