Heard the petitioners, who appear in person and Mr.Rupal, learned counsel for the respondent/University of Delhi. 2.
This Public Interest Litigation petition raises concerns about the alleged violation of Model Code of Conduct for Delhi University Students' Union Elections 2025-26 and has sought a prayer seeking a direction to the authorities of the respondent/University to enforce the said Model Code of Conduct Rules strictly. Certain instances have been cited in the writ petition, where according to the petitioners, the complaints made in relation to violation of the Model Code of Conduct Rules have not been attended to by the respondent/University.

Mr.Rupal, learned counsel for the respondent/University of Delhi, however, denies the said allegations and has stated that the elections are going and filing of nomination papers has commenced today. He has further brought to the notice of the Court that wherever any such violation is found or noticed, the authorities of the respondent/University are issuing Show Cause Notices. about 12 in number, have been tendered to the Court, which are taken on record.

It is common knowledge that ordinarily during the course of Students' Union Elections, some or the other violation of Code of Conduct is reported and accordingly, it becomes the duty of the authorities of the respondent/University to ensure that the elections take place not only in conformity with the Model Code of Conduct Rules but also in accordance with the Lyngdoh Committee Report. It is also the duty of the authorities of the respondent/University and other concerned to ensure that election takes place in a peaceful and orderly manner.

The steps being taken by the authorities of the respondent/University may or may not be adequate to ensure such smooth elections, however without making any observations on the same, we dispose of this writ petition with the hope and trust as also a direction, that the authorities of the respondent/University shall strictly follow and enforce the Model Code of Conduct Rules for Delhi University Students' Union Elections 2025-26. 6.
We also observe that it will always be open to the authorities of the respondent/University to seek help and cooperation of the local police and whenever any such request is made, the same shall be immediately attended to by the police authorities.
