This petition is filed by the Petitioner under Section 11(6) of the Arbitration and Conciliation Act, 1996 for appointment of a Sole Arbitrator to adjudicate the disputes between the parties. 4.

Learned counsel for the Respondent takes a preliminary objection to the maintainability of this petition on the ground that neither in the notice invoking arbitration clause nor in the petition, any claims have been made with respect to the salary which the Petitioner's counsel orally claims is the dispute requiring reference to arbitration.

Having perused the notice invoking arbitration as also the petition, this Court finds merit in the objection. However, it is settled that a party cannot be left remediless.
