This is a petition under Article 226 of the Constitution read with Section 528 BNSS seeking directions to the competent authority to release the petitioner on parole for a period of 8 weeks for maintaining social ties with the family in case FIR 359/2011 under Sections 302/404/201/34 IPC PS Amar Colony.

The petitioner is stated to be undergoing life sentence pursuant to conviction in case FIR no. 359/2011 under Sections 302/404/201/34 IPC, PS Amar Colony and stated to be in custody for 13 years and 3 months. The Ld. Counsel for the petitioner submits that petitioner submitted parole application dated 23.05.2025 but the same has not been decided as yet. She further states that as per prison rules such application has to be decided within a period of one month.

The Ld. ASC appearing for the state submits that as per Rule 1213 of Delhi Prison Rules, 2018, the application for parole has to be addressed to the Superintendent Jail but in the present case such application was addressed to the Deputy Secretary, Home and therefore, could not be decided within the stipulated period.

Since petitioner has already filed the application for grant of parole, the present petition is disposed of with direction to the competent authority to dispose of such application of the petitioner within a period of two weeks. 6.

Copy of this order be sent to the Superintendent Jail for information and necessary compliance.
