Learned counsel for the plaintiff submits that the plaintiff has brought demand draft for Rs.13,33,00,000/- and they tender the same to the defendants.

Learned counsel for the defendants submits that the petition for quashing of FIR No.485/2017 was listed on 19th December, 2018 when plaintiff appeared and gave his no objection to the quashing of the FIR. However, the petition for quashing of the FIR has been adjourned to 18th February, 2019.

It is submitted that the defendants shall accept the balance sale consideration and hand over the possession to the plaintiff after quashing of the FIR.

Learned counsel for the plaintiff submits that the payment of the balance sale consideration, handing over of the possession and execution of the sale deed is not subject to the quashing of the FIR. 5.
It is further submitted that plaintiff was required to give his no objection and appear before the concerned Court and they have discharged
the said obligation.
It is further submitted that the plaintiff shall appear before the concerned Court on 18th February, 2019 but the defendants should discharge their obligation recorded in para -1(i) of the order dated 21st November, 2018.

At request of learned counsels for the parties, list on 1st February, 2019 at 02:30 p.m.
