The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 assails the orders dated 01st October, 2024 passed by the ASJ-05, Central District, Tis Hazari Courts, Delhi and 18th January, 2024 passed by Metropolitan Magistrate, Central District, Tis Hazari Courts, Delhi. By the impugned order, the Magistrate, on an application under Section 156(3) of the Code of Criminal Procedure, 1973,1 directed the registration of FIR No. 392/2024 under Section 306 of the Indian Penal Code, 1860 at P.S. Kamla Market against the Petitioner. Subsequently, on 1st October 2024, the Sessions Court dismissed the Petitioner's revision petition challenging this order.

The Petitioner has participated in the investigation, and extended full cooperation.

Mr. Amit Ahlawat, APP for the State, acknowledges the above fact and, on instructions, submits that the investigation is nearing completion and the final report under Section 173 of the Cr.P.C. is expected to be filed imminently.

In light of the above, counsel for the Petitioner states that he would like to withdraw the present petition and seeks liberty to take recourse to appropriate remedies in accordance with law, should the final report be unfavourable to the Petitioner.
