1. It is stated that the Arbitrator appointed has expired. It is prayed that anther Arbitrator be appointed in his place.

2. Mr. Vikas Dhawan, learned counsel for the non-Applicant Petitioner states that he has no objection if the application is allowed.

3. For resuming the arbitration from the stage where it was when the previous Arbitrator expired, the Court appoints Mr. Ram Murti Bajpai, a former Additional District Judge, Uttarakhand (Mob. 9654312693) as sole Arbitrator. The learned Arbitrator will fix his own terms.

4. The parties will appear before Mr. Bajpai on a date convenient to him. The venue of arbitration shall be arranged by the Petitioner. The parties shall ARB.P. 80/2015

share the expenses thereof.

5. Either of the parties may collect the entire arbitral record from the office of the previous Arbitrator and place it before the new Arbitrator without delay.
