The present Writ Petition (Civil) has been filed under Article 226 of the Constitution of India read with the Section 151 of the Code of Civil Procedure, 1908, seeks to set aside the impugned Order dated 22.08.2025, passed by the learned Presiding Officer, Debt Recovery Tribunal-1 ["DRT"], New Delhi, in the Securitization Application bearing No. SA/291/2025.

Learned Counsel appearing for the Petitioners submits that the Petitioners are neither borrowers nor guarantors and therefore have preferred the present Writ Petition. However, the expression used in Sections 17 and 18 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 ["SARFAESI Act"], SARFAESI Act entitles "any person" aggrieved to approach the concerned forum, as the case may be. Since an Appeal is maintainable against the impugned Order before the Debt Recovery Appellate Tribunal by "any person" aggrieved, we are of the considered opinion that the Petitioners have an effective alternative statutory remedy.

Consequently, this Bench does not find it appropriate to interfere in the present matter.

The present Writ Petition, along with pending application (s), if any, is accordingly disposed of.
