Pursuant to the order dated 15.09.2025, DDA is stated to have filed a short affidavit. However, the same is not on record. Another copy of the short affidavit has been handed over across the bar. The same is taken on record.

In the said affidavit, respondent no.1/DDA has taken a stand that the properties of petitioners have not been identified for demolition, which action has been proposed vide demolition notice dated 28.08.2025. Para 3 and 4 of the short affidavit reads thus:

directions of this Hon'ble Court vide order dated 15.09.2025, an inspection was conducted by the officials of the Answering Respondent. Pursuant to the said inspection, it was ascertained that the dwelling units of the petitioners in the present petition do not fall within the 39 unauthorized units identified in the said demolition notice dated 28.08.2025. Copy of the photographs of the Petitioner's unit(s) are annexed hereto and marked as Annexure-1.

It is further submitted that as per the directions of this Hon'ble Court, the list of 39 units handed over by the Ld. Counsel for the Petitioner has been duly verified. Upon verification, it is confirmed that the units listed therein correspond to the unauthorized structures covered under the said demolition order dated 28.08.2025.
However, it is respectfully submitted that certain remarks made by the petitioner in the said list against some units are factually incorrect."

Learned counsel appearing on behalf of respondent no.1/DDA further submits that the process of rehabilitation under the Policy of Rehabilitation and Relocation, 2017 is underway and the case of petitioners will be considered in accordance with the policy.

In view of the above stand taken by respondent no.1/DDA, learned counsel appearing on behalf of petitioners submits that he does not wish to press the present petition any further.

Petition along with pending application stands disposed of in the above terms.
