CRL.M.A. 28109/2025 (modification of order dt. 09.09.2025) 1.
This is an application seeking modification of order dated 09.09.2025 passed in W.P.(CRL) 2887/2025. The relevant para of the order reads as under:
"6. Since as per order dated 28.08.2025, petitioner is scheduled to surrender today, petition is disposed off with liberty to the petitioner to apply afresh for first spell of furlough in the current conviction year and make a request for waiver of one month period prescribed in Rule 1212 of the Delhi Prison Rules. Once The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 19/09/2025 at 12:29:45
such an application is filed, the appropriate authorities to decide and dispose of such application as per Rules within a period of one month."

Learned counsel submits that there was typographic error in the order inasmuch as 'one month' was mistakenly written instead of 'one week' for disposal time of furlough application Rule 1212 DPR, 2018. 3.
Learned ASC appearing for the State submits that State has no objection for grant of such direction and the State would dispose of the application in an expeditious manner.

Learned counsel for the petitioner submits that petitioner has since filed the fresh application for the 1st spell furlough in the current conviction year. Taking note of the submissions, in furtherance to the order dated 09.09.2025, it is directed that the said application if already filed be disposed of by the competent authority within a period of 1 week. 5.
Application, accordingly, stands disposed of in terms of the aforesaid order.

Copy of the order be sent to the Superintendent Jail for information and compliance.
