Applicant seeks anticipatory bail in FIR No.89/2025 dated 17.02.2025, registered at P.S. Safdarjung Enclave, for commission of offences under Sections 20/29 of Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985.

The abovesaid FIR was registered on 17.02.2025, when four accused persons, including one CCL, were apprehended with commercial quantity of ganja. During Interrogation, these accused persons revealed about the involvement of one Vinod Kumar and his aunt (mausi) i.e. Dhanwati Kumari and claimed that the transported ganja used to be handed over to them. 3.
Fact remains that during investigation, said Vinod Kumar was apprehended and, eventually, since nothing was recovered from him, Vinod Kumar was also released on bail.

When anticipatory bail application of applicant Dhanwati Kumar was taken up by learned Predecessor Bench on 11.09.2025, the following orders were passed:- "1. Issue notice. Learned APP accepts notice on behalf of the State and seeks time to file status report.

2. It transpires that as per the medical certificate appended with the petition, the petitioner suffers from 84% post-polio impairment.

Given her medical condition coupled with the fact that she was earlier also accorded the concession of interim protection by the learned Sessions Court and there is no reported misuse of the same during that period, till the next date of hearing, no coercive steps shall be taken against her, provided she makes herself available for investigation as and when required by the Investigating Officer."

The abovesaid order continues to be in operation. 6.
When asked, Ms. Dalal, learned Addl. P.P. for State, on instructions from Investigating Officer, who has also joined the proceedings, submitted that pursuant to the directions given by this Court, the applicant has already joined the investigation.

According to learned counsel for the applicant, the involvement of the applicant is, merely, on the basis of disclosure statement of her co-accused which is not admissible in evidence.

However, Ms. Dalal, learned Addl. P.P. for the State submits that there are other corroborating material in the shape of CDR and bank record. 9.
The Investigating Officer has claimed that she is already having one more involvement in NDPS matter.

Learned counsel for the applicant states at the Bar that the other case i.e. Sessions Case No.NDPS-24/2018 in FIR No.156/2017 dated 22.11.2017, registered at Police Station GRP Ambala Cantt, under Section 20-B of NDPS Act has already been disposed of by the concerned Trial Court on 13.02.2020 and the applicant has already been acquitted in said case. 11.

in mind the overall facts, her medical condition and the fact that on identical allegations, her nephew Vinod Kumar has already been released on bail and charge-sheet qua them has already been filed, the abovesaid order is made absolute and it is directed that applicant shall keep on assisting the investigation and on her arrest, she be released on bail by the concerned SHO/IO/arresting officer, on her furnishing personal bond and surety bond in a sum of Rs.25,000/- each.

Application is, accordingly, disposed of.
