The present petition under Article 226 of the Constitution of India, 1950 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 482 of the Code of Criminal Procedure, 1973), seeks pre-mature release, as per the policy/order dated 16th July, 2004 issued by the Govt. of NCT of Delhi.

The Petitioner is a life convict in FIR No. 81/2010 registered under Sections 302/34 of the Indian Penal Code, 1860 at P.S. Sadar Bazar. 3.

Counsel for the Petitioner contends that the Petitioner's name has not been forwarded to the Sentence Review Board1 for consideration of premature release despite having completed 14 years in judicial custody, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. without remission.

Mr. Yasir Rauf Ansari, ASC for the State, submits that the Petitioner cannot directly approach this Court for remission and his case, if found eligible, must first be considered and deliberated by the SRB. 5.

The present petition is disposed of with a direction to the Jail Superintendent to consider the instant petition as a representation on part of the Petitioner. If the Petitioner is found eligible, the Jail Superintendent shall forward his case to the SRB, after due compliance with all requisite formalities.

All rights and contentions of the parties are left open. 7.

Copy of the order be sent to the concerned Jail Superintendent, for necessary information and compliance.
