O R D E R

% 31.01.2019 Present suit has been filed by the plaintiff seeking recovery of monies.

It is pertinent to mention that the plaintiff was one of the investors in defendant no.2's project, namely, MGM Grand Project, New Delhi.

Since majority of the investors in the aforesaid project have already filed a representative suit being CS(OS) No.176/2015 and a substantial sum of money has been released to all the investors, this Court is of the view that it would be appropriate if the plaintiff in the present suit impleads herself in CS(OS) No.176/2015. After some arguments, learned counsel for the plaintiff wishes to withdraw the present suit without prejudice to the rights and contentions of the plaintiff and with liberty to seek impleadment in CS(OS) No.176/2015.

With the aforesaid liberty and without prejudice to the rights and contentions of the plaintiff, the present suit is allowed to be withdrawn.

Registry is also directed to issue to the plaintiff a certificate authorizing her to receive back from the Collector the full amount of the Court fee paid by her in the present suit. MANMOHAN, J JANUARY 31, 2019/KA
