By the present petition, the petitioner challenges the order dated 10.05.2024, passed by the learned District Judge-01, South West, Dwarka Courts, pursuant to which his application under Order IX Rule 7 of the Code of Civil Procedure, 1908 (CPC) for setting aside the order passed by the learned Trial Court proceeding ex parte against the petitioner, was dismissed. 2.

The learned counsel for the petitioner submits that the trial had since proceeded and the decree has also been passed. 3.

She submits that the petitioner is taking steps to challenge the decree and requests that liberty be given to take all arguments as taken in the present petition in the petition that may be filed against the final order passed by the learned Trial Court. 4.

She seeks to withdraw the present petition with liberty as requested above.

withdrawn with liberty to the petitioner to take all arguments in the petition that may be filed challenging the decree passed by the learned Trial Court. Pending applications also stand disposed of.
