Petitioner, defending the suit for recovery of money has assailed order dated 27.07.2024 of the learned trial court, whereby his application to recall order dated 03.07.2023 was dismissed. By way of order dated 03.07.2023, the learned trial court refused to take the Written Statement on record as the same was filed after a delay of seven months and without any application for condonation of delay. It would be pertinent to note that order dated 03.07.2023 has not been challenged by the petitioner. 2.

After addressing partly, learned counsel for petitioner seeks permission to withdraw this petition with liberty to file fresh petition, assailing orders dated 27.07.2024 as well as 03.07.2023. 3.

As requested, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought in accordance with law.
