After some hearing, with the consent of the learned Counsel for both sides, this appeal is disposed of by upholding the direction of the impugned judgment of the learned Single Judge in so far as it directs the extension, to the respondent, of the benefits of the New Pension Scheme. However, so far as the direction to return the Central Provident Fund1 dues which have been availed by the respondent is concerned, Mr. Rajesh Tyagi, learned Counsel for the respondent, agrees to return the said amount with 56 % increase along with 6 % interest cumulative from the date on which the amount of CPF was availed.

with within a period of four weeks from today. 3.
