After some arguments, learned Counsel for the Petitioner seeks and is granted permission to withdraw the present Petition with liberty to take steps in respect of his contention that he wishes to challenge the title of the Respondent over the suit property.

The present Petition is dismissed as withdrawn with liberty granted as prayed for, albeit in accordance with law. The pending application also stands closed.

It is clarified that this order is being passed without prejudice the rights and contentions of both the parties.
