This petition has been filed by the petitioner praying for the following reliefs:- "a.

Issuance of a writ in the nature of mandamus or any such order by directing the Respondent No. 2 to 5 for calling the basic pay fixation record of the Petitioner SI/GD Chandrasekhar Mandal Force No. 850828839 from the joining to till date in order to rectify the basic pay scale of the Petitioner in interest of justice.

b.

To issue a writ of mandamus or any such order by directing the Respondent No.2 to 5 to fix/correct the basic pay scale of the Petitioner @ Rs. 56,900/- p.m. alike to the juniors/similar to the placed personnel;

c.

To issue the writ of mandamus or any such order directing the Respondent No. 2 to 5 to grant all the subsequent benefits arising therefrom to the petitioner and the respective arrears after re-fixation of his basic pay scale be granted to the petitioner along with his pension."

The petitioner claims that he joined the CRPF as a Constable/GD on 16.08.1985, and is receiving a lower basic pay than the similarly situated personnel, including his juniors. The petitioner alleges that he had submitted a representation dated 01.09.2023 to the respondents, however, till date, he has neither received a response nor has his pay been rectified.

In view of the averments made in the petition, the respondents are directed to treat the present petition as a representation of the petitioner and take a reasoned decision thereon within a period of six weeks from today. They shall communicate their decision to the petitioner within this period.

We make it clear that we have not expressed any opinion on the merit of the request made by the petitioner and it shall be open to the respondents to decide the same.

In case the petitioner is aggrieved of the order passed by the respondents, it shall be open to the petitioner to challenge the same in accordance with law.

The petition is disposed of with the above directions.
