O R D E R

% 09.03.2018 The appellant Indian Institute of Technology's grievance is that the learned Single Judge ignored and overlooked the statutory regulations that stipulated minimum academic achievements as part of the continuing educational requirements for the purposes of ongoing registration. It is urged that the Single Judge also overlooked the material fact that the respondent/writ petitioner had in fact been afforded an opportunity to better his grades despite which he was unable to do so. This Court is of the opinion that these facts do not appear to have been brought on record and, therefore, could not have been considered. It is, therefore, appropriate for the appellant to move the Single Judge on these aspects.

Learned counsel seeks liberty to withdraw the appeal and move the learned Single Judge, in a review. Liberty granted. In case the review is filed, the same shall be considered on its merits in accordance with law.

The appeal is dismissed as withdrawn. All the pending applications also stand disposed of.
