A perusal of the Impugned Order dated 27.05.2003 passed by the Central Administrative Tribunal [hereinafter referred to as „the Tribunal‟] in O.A. No. 1361/2003 reveals that the same came to be issued on the very first date of hearing, without affording an opportunity of hearing to the Petitioners, who were arrayed as Respondents before the Tribunal.

In essence, the Tribunal directed that the earlier service rendered by the Respondent herein in the Directorate of Health Services, Delhi Administration and in the Health Centre, University of Delhi be counted as qualifying service for the purposes of pensionary benefits.

In the considered view of this Court, such a direction ought not to have been issued without granting a reasonable and effective opportunity of hearing to the Petitioners.

dated 27.05.2003 cannot be sustained and is accordingly set aside. The matter is remitted back to the Tribunal for a fresh adjudication in accordance with law, after granting due opportunity to all concerned parties.

The parties, through their learned counsel, are directed to appear before the Tribunal on 18.03.2026.

The Tribunal is directed to make an endeavour to expedite the disposal of O.A. No. 1361/2003.

In view of the above directions, the present Writ Petition stands disposed of.
