Mr. Siddhartha Sinha, Sr. Standing Counsel has placed before us a circular issued by the Central Board of Direct Taxes dated 19.03.2024, wherein instructions have been issued for early disposal of the pending appeals at the level of CIT (A/AU) and Addl./Jt. CITs Appeals in the following cases :

i.

Cases having demand above one crore rupes, or ii.

Cases where directions to this effect have been issued by Courts, or iii.

Cases where request is made by senior citizen(s) and/or super senior citizen(s) or iv.

Any other case of genuine hardship.

Mr. Sinha states that appropriate shall be for the petitioner to make a request to the Jurisdictional Assessing Officer relying upon the above circular and highlighting the genuine hardship being faced by the petitioner for recommending early disposal of the appeal pending before the CIT Appeals.

Mr. Gandhi states, in view of the submission made by Mr. Sinha, he shall withdraw the present petition and make request to the Assessing Officer. If such a request is made, the Assessing Officer shall consider the request in accordance with law and decide the same within six weeks as an outer limit.

The petition is disposed of.
