% 06.04.2016 Learned counsel for the petitioner has submitted that aggrieved by not summoning of the accused Mr.Khusbakht Rai who was put in column no.12 of the chargesheet and who is not party in this case, the petitioner filed an application before learned Metropolitan Magistrate for summoning him and against the same, the revision petition was filed which was dismissed on 6th January, 2014. During the course of arguments, learned counsel for the petitioner wishes to withdraw the present petition in order to seek remedy under law.
