O R D E R

By the present application, the applicant seeks extension of interim bail for a period of 90 days in NCB Case No. VIII/36/DZU/2024 for offences under Sections 8(c)/21(c)/23(c)/25/27A/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

By order dated 06.08.2025, in BAIL APPLN. 2657/2025, considering the medical status of the applicant as well as his clean antecedents, this Court had granted interim bail to the applicant for a period of four weeks. The interim bail was further extended by this Court vide order dated 03.09.2025 in BAIL APPLN. 3364/2025 noting that the applicant was required to undergo a minor surgery in regard to varicose veins. 3.

Extension of interim bail is sought on the ground that the applicant, on account of multiple ailments, has not been able to undergo the surgery in regard to varicose veins. Status Report has been handed over in Court today. The same is taken on record.

The document of Park Hospital filed by the prosecution pursuant to the verification indicates that no surgery is required to be performed.

The learned counsel for the applicant, however, submits that the date for surgery is fixed for tomorrow. She also relies upon one document dated 09.09.2025 issued by the same Hospital, that is, Park Hospital, which mentions that the applicant is required to undergo surgery on 12.09.2025. 7.

The document filed by the prosecution is dated 11.09.2025.

Be that as it may, since the learned counsel for the applicant submits that the surgery of the applicant is to be performed tomorrow, the interim bail granted to the applicant by order dated 03.09.2025 passed in BAIL APPLN. 3364/2025 is extended for a period of four days on the same terms and conditions as imposed earlier. The applicant is directed to surrender on or before the expiry of a period of four days. 9.

It is made clear that if the surgery is not performed tomorrow, the period of extension of interim bail is directed to be reduced to day after tomorrow, that is, 18.09.2025 and the applicant is then directed to surrender on or before 18.09.2025. 10.
