Both these directionshave been compliedwith. In fact, the petitioner was permitted to participate in the auction and his bid was not treated as nonresponsiveon this ground. However,the petitionercouldnot succeedbecause he did not fall within the 50% criterion in terms of Clause 3.3.2 of the tender •*>"
