The Criminal Appeal filed by the petitioner was dismissed by order dated 06.08.2024 on the ground that the same was filed with a delay of three days.

The learned Additional Sessions Judge noted that no explanation has been given for condoning the delay. 3.

This Court finds no infirmity in the order passed by the learned Trial Court. However, considering the fact that the petitioner is a woman and the delay was only three days, this Court considers it apposite to give one more opportunity to the petitioner to present her case before the Appellate Authority. 4.

In view of the above, the impugned order is set aside and the appeal is restored to its original number. 5.

The matter is now directed to be listed before the concerned Appellate Court on 28.11.2024 to be considered on its own merits.
