This is a petition filed under Section 9 of the Arbitration and Conciliation Act, 1996 ("1996 Act") seeking amongst others the following interim reliefs against the respondents: "a. grant an injunction restraining Respondent Nos. 5 and 6 from dealing with, selling, transferring, alienating, disposing of, encumbering or creating third party interests in any manner whatsoever in respect of the shares held by them in Respondent No. 1;

from exercising any voting rights in respect of the shares held by them in Respondent No. 1;

Mr. Jain, learned senior counsel appearing for the petitioner states that the Consortium Agreement dated 16.08.2024 between the parties herein contains an arbitration clause being Clause No. 11. Hence, the present petition has been filed under the aegis of the said arbitration clause.

However, my attention has been drawn to an order passed by the Hon'ble Supreme Court in ARBIT. PETITION. No. 000052/2025 dated 25.08.2025, wherein the Hon'ble Supreme Court has dismissed the petition filed under Section 11 of the 1996 Act by the petitioner for appointment of an Arbitrator.

Once the petition under Section 11 of the 1996 Act has been dismissed by the Hon'ble Supreme Court, the present petition under Section 9 of the 1996 Act shall not lie and hence, is dismissed. 5.

If and as and when the order dated 25.08.2025 of the Hon'ble Supreme Court is modified, the petitioner shall be at liberty to revive the present petition.

Accordingly, the present petition is disposed of with pending applications, if any.
