Learned counsel for the respondent no.2-National Board of Examinations in Medical Sciences, has placed on record a communication dated 13.09.2024, and submits that as per clause 10.4 of the information bulletin, the leave availed by the petitioners were clubbed together and the petitioner was allowed to appear in the DNB-Final theory Examination, October, 2024 Session, on provisional basis.

Learned counsel for the respondent no.2, contends that the further eligibility of the petitioner shall be examined in view of the extant regulations.

The petitioner mainly impugns the communication dated 24.09.2024, wherein, the request of the petitioner for clubbing of the leaves was rejected. 4.

The Court vide order dated 03.10.2024 passed an interim order and, prima facie opined that clause 10.4 of the information bulletin permits the leaves to be clubbed together, which have been obtained on account of prolonged illness.

The Court, under the aforesaid circumstances, directs the respondent no.2 to be bound by the interim order; however, it shall be at liberty to consider the further eligibility, in accordance with the extant regulations for practical examination.
