Writ Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 8Cr.PC9) new Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the Petitioners for quashing of FIR No. 224/2018 dated 04.10.2018 under Section 323/341/427/356/379/506/34 of the Indian Penal Code, 1860 (hereinafter referred to as 8IPC') registered at Police Station Naraina, Delhi and all the consequential proceedings emanating therefrom, in view of the Settlement dated 28.08.2024. 2.

Brief facts of the case are that on 30.06.2018, the Respondent No. 2 went to his friend Akash's brother's reception party at Patel Banquet Hall in Narayana, with his friend and mother. After some time of their asking, a family quarrel started in the program and Kunal Sudan, Naresh Kumar Sudan and Abhishek Sudan started a scuffle. After which, The Respondent No.2 took the car out in the parking, when Kunal Sudan came running and broke the rear glass of car as soon as the Respondent No. 2 got out of the driving seat, Kunal Sudan and Abhishek Sudan caught hold of the Respondent No. 2 and hit him on the head with the rod due to which, blood started oozing out of the Respondent No. 2's head. Some of their friends also started attacking on the Complainant and in this attack, they tore his bracelet and snatched away the chain from his neck and took away the locket of the Complainant's friend, Nakul. The attack was done with the intention to kill him.

On the Complaint of the Respondent No.2/Complainant, FIR No.224/2018 dated 04.10.2018 under Section 323/341/427/356/379/506/34 of IPC, got registered at Police Station Naraina, Delhi. 6.

It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 28.08.2024. In the Settlement, it was inter alia settled between the parties that they have left with no grievance against each other. It is settled between the partis that they shall agree to give their respective No Objection(S)/Affidavits. 7.

Today, the Respondent No. 2, who is present in the Court, states that he has no objection if the said FIR is quashed. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Ther parties are present in person today in the Court and they have been identified by their respective learned counsels and the Investigating Officers. They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 224/2018 dated 04.10.2018 under Section 323/341/427/356/379/506/34 of IPC, registered at Police Station Naraina, Delhi and all the consequential proceedings emanating therefrom are quashed.

The Petition is disposed of accordingly.
