% 12.08.2016 CA No.2976/2016 & CO.PET. 323/2014 This joint application has been moved praying that the petition be disposed off in terms of a settlement concluded between the parties on 25.07.2016. Copy of the said agreement has also been annexed to this application.
Both counsel approbate the terms of the settlement and undertake to this Court on behalf of their respective clients to remain bound by the terms and conditions thereof. Counsel for the respondent, under instructions of Mr.Sidharth Bhatia, Director/Authorized Signatory of the respondent Company personally present in Court, specifically undertakes to this Court that all instalments, as envisaged in the settlement, shall be duly paid to the
petitioner. These undertakings are accepted by this Court and they shall remain bound by the same. The application is also supported by affidavits of the authorised representatives of both parties. Mr.Sidharth Bhatia, Director/Authorized Signatory of the respondent company has also filed an affidavit in support of the relief sought in this application on behalf of the respondent-company.
Counsel for the petitioner states that he does not wish to press this petition any further, whilst reserving the right to institute any fresh proceeding including, inter alia, by way of contempt in case of any violation or default by the respondent; and if he is so advised. He is permitted to do so.
Consequently and as prayed, the petition, as well as the interim applications, stands disposed off.
