Learned Counsel for the Appellant submits that the issue in the present Petition also obtains in the matter that was pending before the Supreme Court in Civil Appeal No.329/2005 captioned Union of India & Ors. vs. M/s. Cipla Ltd. & Anr.

1.1 Learned Counsel for the Appellant submits that the judgment has already been passed by the Supreme Court on 21.10.2016 in the said Appeal. 2.

Learned Counsel for the parties submit that nothing further survives in the present Petition.

Learned Counsel for the Appellant seeks and is granted permission to withdraw the present Petition.

The present Petition is accordingly dismissed as withdrawn. Pending Application stands closed.
