In view of the judgment of the Supreme Court in the case of Shashi Gaur Vs. NCT of Delhi, (2001) 10 SCC 445 which holds that an action of termination of an employee of a school has necessarily to W.P.(C) 11764/2006
be challenged by filing of an appeal before the Delhi School Tribunal under Section 8 (3) of the Delhi School Education Act, 1973, accordingly, at request, these writ petitions are taken as appeals filed before the Delhi School Tribunal with the date of filing of the appeals before the Delhi School Tribunal being the date on which the writ petitions were filed in this Court and these writ petitions are therefore transferred for decision as appeals before the Delhi School Tribunal under Section 8 (3) of the Delhi School Education Act. 2.
Parties to appear before the Delhi School Tribunal on 21st February, 2017. Registry shall ensure that the files of these cases are made available to the Delhi School Tribunal on the date fixed. In case the respondents do not appear before the Delhi School Tribunal on the date fixed, the Delhi School Tribunal will issue notice to the respondents before disposing of the appeals.
