% 30.11.2016 IA No. ________(To be numbered) Learned counsel for the plaintiffs has handed over a joint application under Section XXIII Rule 3 CPC, inter alia, praying that the suit be decreed in terms of the settlement as recorded in paragraph 2 of the application. In terms of the para two of the application the parties have acknowledged that plaintiff No. 2 is the proprietor of the trademark VOLVO. The defendants have further acknowledged and admitted the validity of the plaintiffs' trademark registrations as set out in paragraph 16 of the plaint. They further agreed that they would use their trademark VOVO only along with a suffix or a prefix. The agreement is affirmed by the parties and is lawful.

Accordingly, the application is allowed and suit is decreed in terms of

agreement as set out in paragraph two of the said application. The decree sheet be drawn. The application shall form part of the decree sheet. VIBHU BAKHRU, J NOVEMBER 30, 2016 pkv
