After some hearing, Mr. Rajiv Tyagi, learned counsel for the petitioner - Hindustan Coca-Cola Beverages Private Limited, seeks permission to withdraw the present revision petition, without prejudice to the rights and contentions of the petitioner, who is the defendant in the suit, before the Trial Court.

Mr. Tyagi further submits that the cause of action of the plaintiff [respondent herein] would have to be adjudicated against the Municipal Corporation of Delhi ["MCD"] and its agent through whom the machine, which allegedly caused injury to the plaintiff, was installed. This aspect, however, need not be examined in the present revision petition, and the parties are at liberty to raise the same before the Trial Court, if so advised.
