The Department has challenged the issuance of notice to the respondent for hearing at the stage of cognizance. 3.

Mr. Zohaib Hossain, special counsel for ED states under instructions that prosecution complaint in the present matter was filed on 06.09.2024 and therefore, fairly concedes that in terms of proviso to Section 223 BNSS the petitioner needs to be heard before taking cognizance and, thus, seeks permission to withdraw the present petition.

The statement made by the learned special counsel under instructions from the Directorate of Enforcement is taken on record and the present petition is dismissed as withdrawn.
