The present Appeal filed under Section 10 of the Delhi High Court Act, 1966, read with Section 151 of the Code of Civil Procedure, 1908, challenges the Interlocutory Order dated 28.08.2025 passed by the learned Single Judge in I.A. 5453/2023 in CS(OS) 556/2008, titled "Jamna Datwani & Anr. v. Anand Datwani & Ors.". 2.

After arguing at some length, learned counsel for the Appellant seeks leave to withdraw the present Appeal. However, he submits that a request be sent to the learned Single Judge to consider the application for the inclusion of the Legal Representatives ("LRs") of Plaintiff No. 1, namely, Smt. Learned counsel for the Respondent No.3 submits that an application in this regard is already pending and is scheduled for hearing before the learned Single Judge today. 4.

Keeping in view the aforesaid facts, the present Appeal is dismissed as withdrawn, while requesting the learned Single Judge to consider and decide the application for bringing on record the LRs of the deceased Smt. Jamna Datwani, in accordance with law. 5.
